1. Purpose of the Service

The Shiftometer application (hereinafter "the Application") provides awareness and support tools to address the evolution of professions in the era of Artificial Intelligence. The service includes:

A global statistics dashboard (Worldometer)
An automation risk exposure estimation tool (Timer)
Action plans and an interactive AI-driven advisory service (AI Coach)

2. Important Disclaimer

The User acknowledges and agrees that:

Nature of Data: Statistics, risk percentages, and dates provided by the "Timer" are estimates based on forward-looking models and current trends. They do not, under any circumstances, constitute certain predictions or scientific truths.
No Legal or Financial Advice: Career transition paths and training advice are provided for informational purposes only. Shiftometer does not guarantee any results regarding employability or professional success. The User is solely responsible for their career decisions.
AI Limitations: Responses generated by the "AI Coach" are produced automatically. Despite moderation efforts, they may contain errors, inaccuracies, or hallucinations.

3. Permitted Use and Restrictions

Access to the "AI Coach" is strictly limited to its intended purpose: professional orientation and adaptation. The User agrees to refrain from:

Using the AI to generate inappropriate, illegal, or irrelevant content (e.g., homework help, recipes, coding out of context)
Attempting to bypass technical limits (jailbreaking) or saturating the API through automated queries

In the event of misuse, Shiftometer reserves the right to suspend access to the service without prior notice.

4. Intellectual Property

The Application architecture, the database of 2,933 occupations, and proprietary educational content are the exclusive property of Shiftometer. Any reproduction or extraction of the database is strictly prohibited.

5. Pricing and Payments

Certain features (Detailed Action Plan, AI Coach) are subject to a one-time payment or a subscription
Payments are processed securely by our provider (Stripe)
In accordance with legislation on digital content, the right of withdrawal (refund) cannot be exercised once access to premium content has been initiated or consumed

6. Data Protection (GDPR)

Shiftometer is committed to protecting your privacy:

Collected Data: Selected profession, checklist progress, and queries submitted to the AI Coach
Purpose: Service improvement and coaching personalization
Storage: Your data is stored locally (AsyncStorage) and on secure servers for Cloud functions. You have the right to access and delete your data via the Application settings

7. Modification of Terms

Shiftometer reserves the right to modify these Terms of Service at any time to reflect technological or regulatory changes. Continued use of the Application constitutes acceptance of the updated terms.

8. Specific terms — AI Audit (B2B)

These terms apply in addition to the service contract signed between Shiftometer and the corporate client for the delivery of an AI Audit on Jobs, Skills and Tools, and for the production of individual action plans. In the event of contradiction with the general terms, the provisions of the main contract and this section prevail for the relevant engagement.

Scope of the engagement: The audit covers the jobs, skills and tools within the scope defined contractually with the corporate client. The production of individual action plans concerns the persons identified within that scope. Any extension of scope requires a written amendment.
Deliverables: Deliverables consist of a synthetic audit report, a set of individual action plans (one per person within the scope) and, where applicable, implementation recommendations. The formats (PDF, JSON, online platform) are specified in the main contract. No guarantee of operational or commercial result is attached to the recommendations.
Intellectual property of recommendations: The corporate client obtains an internal, non-exclusive and non-transferable right of use over the deliverables produced for its scope. The audit methodology, technical tools, internal prompts and software building blocks used by Shiftometer remain the exclusive property of Shiftometer. Any reuse of the deliverables beyond the internal use of the corporate client (publication, dissemination to third parties, resale) requires prior written agreement.
Limited liability: Shiftometer undertakes a best-efforts obligation. The recommendations resulting from the audit are based on the data provided by the corporate client and the state of the art at the date of production. Shiftometer's liability under the engagement is capped at the amount invoiced for the relevant mission, except in cases of gross or intentional fault. Indirect damages (loss of revenue, loss of image, commercial harm) are expressly excluded.
Retention of deliverables: Shiftometer retains the deliverables and audit data for the duration of the engagement plus three (3) years, unless an early erasure request is made by the corporate client. The precise terms are set out in the internal Retention Policy (`docs/legal/RETENTION_POLICY.md`) and in the GDPR Data Processing Agreement (DPA) signed between the parties.

The processing of personal data (employees, executives) carried out in connection with this engagement is governed by a separate GDPR Data Processing Agreement (DPA), compliant with Article 28 GDPR, signed between Shiftometer (processor) and the corporate client (controller).
